Terms of Service

This is a plain-language agreement, and it is not legal advice. If your business has specific requirements, have your own counsel review it before you rely on it.
1. The agreement
These terms are an agreement between Mayo Maines LLC, a Texas limited liability company that makes Platy OS, and the business that signs up to use it. By creating an account or using the service, you agree to them on behalf of your business. If you do not agree, do not use the service.
2. The service
Platy OS is software for running a landscaping company: quoting, scheduling, dispatch, a crew app, invoicing, card payments, customer texting, a phonereceptionist, a client hub and bookkeeping. What the product does is described on the product tour, and that description, not any salesperson’s promise, is what you are buying. The product is young and improves continuously, which means features will be added and occasionally changed.
3. Accounts and eligibility
The service is for businesses, and you must be at least 18 and able to bind your business to use it. You are responsible for the people you invite into your account: keep logins private, remove people who leave, and tell us promptly if you believe an account has been compromised. What happens under your account’s logins is your responsibility.
4. Fees
Platy OS costs $297 per month, per company, with unlimited users and no per-seat pricing. It is month to month: no contract, no setup fee, cancel anytime, and when you cancel you are not billed again after the current month. If the price ever changes, existing customers get clear notice before it affects them.
Card processing fees are separate and they are Stripe’s, not ours. Because charges go directly into your own Stripe account, Stripe’s processing fees come out on Stripe’s side under your agreement with Stripe. We do not take a cut of your payments.
5. Your data is yours
Everything your business puts into Platy OS, your clients, properties, quotes, jobs, invoices, messages and books, belongs to your business. We claim no ownership of it. You can export it at any time, and if you leave, you can take it with you. We use it only to provide the service, as the privacy policy describes. You give us the limited permission needed to store and process it for you, and nothing more.
6. Acceptable use
Use the service to run your business, lawfully. Do not use it to break the law, to harass anyone, to send spam, to store data you have no right to hold, to probe or overload our systems, or to resell access. Do not try to breach another customer’s data. We can suspend an account that is doing harm, and we will tell you why if we suspend yours.
7. Texting your customers: consent is on you
Platy OS lets you text your own customers, and the law puts duties on the sender. You are responsible for having consent to text the people you text, for honoring anyone who asks you to stop, and for complying with the laws that apply to business messaging, including the TCPA. The product handles opt-outs automatically: when someone replies STOP, the system stops texting them. Do not work around that. If carriers or regulators act against messaging sent from your account without consent, that responsibility is yours.
8. Third-party services
Parts of the product run on services we do not control: Stripe for payments, Plaid for bank connections, Twilio for texting and calls, Anthropic for AI, and the hosting providers named in the privacy policy. Your use of Stripe and Plaid is also governed by your own agreements with them, since those accounts and connections are yours. If a third-party service fails or changes, we will work around it as best we can, but we are not liable for their failures.
9. Availability and support
We work to keep the service up and we take an outage seriously, but we do not promise a specific uptime percentage, and you should not sign anything that assumes one. Planned maintenance happens outside working hours where possible. Support is a real person, reached through the hello@getplaty.com, and early customers deal directly with the people who build the product.
10. No warranty
The service is provided as is. We do not warrant that it will be uninterrupted or error free, and we disclaim implied warranties, including merchantability and fitness for a particular purpose, to the extent the law allows. What we do promise is plainer: we will tell you the truth about what the product does and does not do.
11. Limit on liability
To the extent the law allows, neither side is liable to the other for indirect, incidental or consequential damages, including lost profits. Our total liability for claims arising out of the service is capped at the amount your business paid us in the twelve months before the claim. Nothing here limits liability that the law does not allow to be limited.
12. Indemnity
If a third party brings a claim against us because of how your business used the service, such as messaging without consent or storing data you had no right to, you agree to cover the costs and damages of that claim.
13. Ending the agreement
You can cancel at any time and your service runs through the end of the paid month. We can terminate an account for breach of these terms, with notice and a chance to fix it where that is reasonable. After an account closes, you have at least 30 days to export your data, and we will help you do it. After that we delete what we hold, except what the law requires us to keep.
14. Changes to these terms
If we change these terms, we will change the date at the top, and for changes that matter we will tell you directly before they take effect. Continuing to use the service after that notice means you accept the change. We will not change the deal quietly.
15. Governing law
These terms are governed by the laws of the State of Texas, and disputes belong in the courts of Texas. If a court finds part of these terms unenforceable, the rest still stands.
